Privacy Policy
This Privacy Policy explains how eServicePro Inc. (“eServicePro,” “we,” “us,” or “our”) collects, uses, discloses, and retains personal information when individuals visit our websites, create or use accounts, participate in trials, use our applications and portals, communicate with us, or otherwise interact with the Services. For personal information that eServicePro processes solely on behalf of a business customer, that customer generally controls the purposes of processing and should be contacted first regarding individual privacy requests.
1. Information We Collect
Depending on how you interact with eServicePro, we may collect: account and contact information (such as name, business email, telephone number, organization, role, and credentials); property and service-management information submitted by customers (which may include property, unit, lease, tenant, owner, vendor, maintenance, inspection, work-order, communication, and related records); subscription and transaction information; device, network, log, and usage information (including IP address, browser/device details, timestamps, diagnostics, and security events); communications, support requests, and feedback; and information received from integrations you or your organization authorize. Payment-card credentials may be processed directly by a payment provider; eServicePro does not intend to store full payment-card numbers unless specifically disclosed and appropriately secured.
2. Sources of Information
We collect information directly from you; from your organization or other authorized users; automatically through use of the Services; from integrations you enable; and from service providers or business partners where permitted by law.
3. How We Use Information
We use personal information to provide, authenticate, maintain, secure, and support the Services; administer accounts, trials, subscriptions, transactions, communications, maintenance, and service workflows; detect and prevent fraud, abuse, and security incidents; troubleshoot and analyze performance; develop and improve features, analytics, automation, and AI-enabled functionality consistent with our contractual commitments; communicate service and product information; comply with law; enforce agreements; and establish, exercise, or defend legal claims.
4. How We Disclose Information
We may disclose personal information to hosting, infrastructure, security, analytics, communications, support, payment, AI, and other service providers/subprocessors; to integrations enabled by a customer; to professional advisers subject to appropriate duties; in connection with a financing, merger, acquisition, reorganization, or sale of business/assets; and where required by law or reasonably necessary to protect rights, safety, security, and the integrity of the Services. We may also disclose information at a customer’s direction. We do not use the phrase “never share” because operational disclosures are necessary to provide a SaaS platform. If eServicePro engages in activity legally defined as a “sale” or “sharing” of personal information or targeted advertising, we will provide required notices and opt-out mechanisms.
5. Customer Data; Controller/Processor Roles
When eServicePro processes personal information on behalf of a business customer under that customer’s instructions, the customer generally acts as controller/business and eServicePro acts as processor/service provider, as those terms are defined by applicable law. The parties may enter a Data Processing Addendum (“DPA”) where required. Individuals whose information is contained in a customer account may need to submit requests to the relevant customer; eServicePro will assist customers as required by applicable law and contract.
6. Cookies and Similar Technologies
We may use cookies, local storage, SDKs, pixels, and similar technologies for authentication, preferences, security, fraud prevention, analytics, and permitted marketing. Where required by applicable law, we will provide consent or opt-out choices. Browser settings may allow you to limit certain technologies, although doing so may affect functionality.
7. Data Security
We maintain administrative, technical, and organizational safeguards designed to protect personal information appropriate to the nature of the information and risks involved. Measures may include access controls, authentication, encryption in transit and at rest where appropriate, logging and monitoring, vulnerability management, backups, incident-response procedures, and service-provider oversight. No method of transmission or storage can guarantee absolute security.
8. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal and contractual obligations, resolve disputes, enforce agreements, maintain security and fraud-prevention records, and preserve legitimate business records. Retention periods vary by data category, customer configuration, account status, contractual commitments, and legal requirements. Customer-controlled data may be deleted or returned according to the applicable subscription agreement and DPA.
9. Privacy Rights
Depending on your jurisdiction and applicable law, you may have rights to request access to or information about personal information, correction, deletion, portability, restriction, or objection, and to opt out of certain sale, sharing, targeted advertising, or profiling. You may also have a right to appeal a denied request. We will not unlawfully discriminate against you for exercising applicable privacy rights. We may need to verify your identity and authority before acting on a request. Authorized agents may submit requests where permitted by law. To submit a request, write to eServicePro Inc. at the postal address in Section 15 and clearly mark the correspondence “Privacy Request.” For information controlled by an eServicePro customer, contact that customer first.
10. Sensitive Information
Customers should not submit sensitive personal information unless it is reasonably necessary for an authorized use of the Services and lawful to do so. eServicePro does not intend the standard Services to collect Social Security numbers, full payment-card credentials, consumer-report data, or precise biometric identifiers unless a feature expressly requires such information and appropriate terms and safeguards are in place.
11. Children
The Services are intended for business and property-management users and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13 through a consumer-directed service. Customers are responsible for ensuring that any information about minors submitted through their business use is lawful and appropriately protected.
12. International Processing and Transfers
eServicePro and its service providers may process information in the United States and other countries where they operate. Privacy and data-protection laws may differ across jurisdictions. Where applicable law requires a transfer mechanism or contractual safeguard for cross-border transfers, eServicePro will implement an appropriate mechanism before undertaking the regulated transfer. Enterprise customers may request applicable DPA and transfer terms where offered.
13. Tenant Screening; Consumer Reports
The standard Services do not authorize tenant screening, credit pulls, or consumer-report functionality. If eServicePro later offers such functionality, eServicePro will update applicable notices, contracts, security controls, and workflows before activation. Customers must not upload consumer reports into the standard Services unless expressly authorized and legally permitted.
14. Changes to this Policy
We may update this Policy from time to time. We will post the updated version with a revised effective date and provide additional notice where required by applicable law. Material changes will apply prospectively as required by law.
